Please read the Terms and Conditions below very carefully. Your use of the www.philhoffmanntravel.com web site ("Site") will be deemed to be an acceptance of the Terms and Conditions below.

INTELLECTUAL PROPERTY

All content on the Site is the subject of copyright and unauthorised use of the Site is therefore strictly prohibited. All intellectual property rights in connection with the Site, including copyright, are owned by Phil Hoffmann Travel (in these Terms and Conditions referred to as "PHT", "our", "we" or "us").

You acknowledge and accept that:

  • We cannot and have not checked the accuracy of all information provided by third party travel service providers such as airlines and hotels;

  • We are not responsible for errors, omissions or misleading information in travel information and listings on the Site;

  • You are solely responsible for the suitability of any travel services which you purchase through the Site;

  • We accept no responsibility or liability for any failure or delay on the part of any third party in providing travel services to you, and it is your obligation to seek compensation for any such failure or delay from the relevant third party; and

  • We are not responsible for any acts or omissions of airlines or other third parties in the course of delivery of such travel services.

BOOKING ONLINE

By allowing you to make a hotel, air or car reservation through the Site's booking engine, we are acting as the agent of the hotel, car hire company or airline concerned. We therefore accept no responsibility or liability for any misunderstanding or error in respect of any reservation made by you through the Site.

It is your responsibility to read the booking rules and ensure your booking complies with the booking rules, to carefully check and correct any mistakes in your reservation request and in any confirmation thereof received from the hotel, car hire company or airline.

You hereby consent to our use (including sharing with third parties) of your contact information for all purposes directly connected with your use of the Site (for example, any reservation requests made by you).

You warrant that you are at least eighteen years old, and that you have sufficient credit on your credit card account to meet all charges for travel services you book through the Site.

You must read the travel-specific terms and conditions at the end of these Terms and Conditions and convey all information set out in those specific terms and conditions to any other parties covered by any booking you make.

You must provide us with accurate and truthful information where required on the Site.

You must keep secure any user identification that we provide you with in order to access the Site. You must not permit any other person to use your user identification to access the Site. You are responsible for all use of the Site, and all transactions entered into through the Site, using your user identification, whether authorised by you or not.

We make no express warranties to you, except those expressly set out in these Terms and Conditions.

We exclude:

  • all conditions, warranties and terms implied by statute or general law or custom except any implied condition or warranty the exclusion of which would contravene any statute or cause this clause to be void (“Non Excludable Condition”);

  • all liability to you in contract for consequential or indirect damages arising out of or in connection with your use of the Site even if we knew they were possible or they were otherwise foreseeable, including, without limitation, lost profits and damages suffered as a result of claims by any third person such as you or one of your customers;

  • all liability to you in negligence for acts omissions of us and our employees, agents and contractors arising out of and in connection with your use of the Site.

Our liability to you for breach of any express provision of this Agreement or any Non Excludable Condition (except a Non Excludable Condition implied by section 69 of the Trade Practices Act 1974) is limited at our option to one of supplying, replacing or repairing the goods or supplying again those services in respect of which the breach occurred.

On request by you we will refund any amount paid by you for the goods or services in respect of which the breach occurred, rather than the remedy referred to above.

If you are a consumer, as defined under the Trade Practices Act 1974, we do not exclude liability to you for breach of any Non Excludable Condition in respect of goods or services ordinarily acquired for personal, domestic or household use and consumption.

You acknowledge that:

  • some of the material accessible through the Site is provided by third parties, and that we are not responsible for this material; and

  • we are not responsible for material contained in external web sites that are Iinked to the Site.

GENERAL PROVISIONS

This agreement is governed by the laws in force in South Australia and you irrevocably submit to the non-exclusive jurisdiction of the Courts of South Australia for determining any dispute connected with the Site.

We may legally assign any of our rights and obligations under this agreement at any time by giving you notice in writing.

FARES & PRICES

All airfares and prices displayed on the Phil Hoffmann Travel site are subject to airline/provider availability and do not include taxes or airport or port charges unless indicated. At Phil Hoffmann Travel we do not guarantee fares or prices until the booking has been fully paid for, as airline/hotel/car consistently change fares, availability, fare conditions and class of travel without notice. Fares are also subject to currency fluctuation without notice.


TERMS OF TRADE AND RESPONSIBILITY CLAUSE

Reservation Deposit / Cancellation

The Reservations Deposit is payable at the time the reservation is requested and is in addition to any deposit fees charged by the tour operator/airline or other travel supplier. The Reservation Deposit is non-refundable BUT if you proceed with booking the amount of the Reservation Deposit will be credited against the final amount payable. Upon cancellation, the deposit is forfeited. If the Phil Hoffmann Travel Cost is not utilised within the 12 months, it will be deemed as a cancellation of any booking. In many cases, cancellation fees may be claimed against your insurance policy, and accordingly, travel insurance is strongly recommended.

INSURANCE

A recommended Insurance Policy will be automatically included in your statement. If you choose not to effect our insurance, we will ask you to sign an indemnity declaration. Travel Insurance provides cover when the premium is paid and the policy issued, and so should be taken out as soon as any deposit or payment is made for maximum protection.

DOCUMENT RE-ISSUE FEES 

After documents have been issued, and a reissue is required due to amendments to the booking, then a fee will be charged by Phil Hoffmann Travel; in addition to any charges levied by hotels, ground/cruise operators or airlines. A document reissue means a change to an existing booking and not a transfer to another package.

TRAVEL DOCUMENTATION

Passport, Visa and Health requirements are the responsibility of all individual travellers. Passports are required for all travellers departing Australia. Please check with your consultant for advice. Please Note: Permanent residents travelling on a foreign passport must hold an Australian Re-entry Visa. Many countries require that you hold a passport with at least six months validity when entering foreign nations.

TRAVEL INSURANCE

Phil Hoffmann Travel strongly recommends that all travellers obtain travel insurance against cancellation or amendment fees as well as providing sufficient medical cover. We suggest that the policy should include, but not be limited to the following cover: Loss of deposit through cancellation, loss of or damage to personal baggage and loss of money, medical expenses, additional expenses to cover hotel accommodation and repatriation costs to Australia should the tour need to be extended or curtailed due to illness while overseas, or due to the need to return to Australia because of unexpected death or illness of a close relative. This feature should also cover cancellation of transport services due to industrial action. Some age and pre-existing illness conditions may apply.

EXTRAORDINARY COSTS

In the unlikely event we are unable to meet your requirements through our normal booking process or you request a late booking which requires urgent attention, we will let you know. If you wish us to continue with the booking any additional costs such as telephone and other communication expenses, courier changes and associated bank costs for urgent remittance of funds will be payable by the client.

LIABILITY

We cannot accept responsibility for any travel service, rules or conditions that are incorrectly represented within this website’s booking system. The data and services shown are provided in good faith. In no event shall Phil Hoffmann Travel be liable for any injury, loss, claim, damage or any incidental or consequential damages, including but not limited to lost profits or savings, arising out of or in any way connected with the use of any display within this site.

CHANGES TO THESE TERMS AND CONDITIONS

Phil Hoffmann Travel has the authority to change or modify all or any part of these terms and conditions at any time it sees fit, without prior notice.

REFUNDS

No refund is available for cancellations after the tour has commenced or in respect of any tours, accommodation, meals or any other services not utilised. Credit offers cannot be refunded or taken as cash.

INTERNATIONAL TOUR CONDITIONS

Reservations

A deposit of $600 per person is required within 7 days of confirmation of your booking. This deposit forms part of the total price, balance of which is due 60 days prior to the departure date from Australia. The full tour price is due at the time of booking made within 60 days of departure.

Baggage

The free baggage allowance on flights is restricted to 20kgs per person for economy passengers and 30kgs per person for business class passengers. Whilst on tour one bag per person is allowed. Any charge for baggage in excess of these allowances will be at the passenger's expense.

Cancellations

Cancellations of firm bookings will be subject to $220 per person service fee (Bookings over $10,000 $550 per person) plus any charges imposed by principals involved in operating the tour. Therefore, the cancellation fee may be up to the total cost for land and/or airfares.

Insurance

We strongly recommend participants to take out insurance cover against loss of deposit and loss of airfares, personal accident, medical cover etc. If you have sought treatment or advice for treatment within the last 60 days or are on prescribed medication or over 70 years of age you are required to complete a pre-existing medical form for review by the Insurance Company. Ask your Consultant for details.

Passport & Visas

It is necessary for all passengers to be in possession of a valid passport. If travelling on an Australian passport it must have at least 6 months validity remaining upon return into Australia. Visas may be necessary for some countries. Your Consultant will assist you with any queries.

Alterations

Tour prices specified are based on airfares and land arrangement tariffs applicable at the time of printing. Prices are based on currency exchange rates therefore may be subject to alteration with or without prior notice.

Phil Hoffmann Travel reserves the right to alter or omit any part of the itinerary or change of reservation, features and/or means of conveyance without any notice and for any reason whatsoever.

Refunds

No refund is available for cancellations after the tour has commenced or in respect of any tours, accommodation, meals or any other services not utilised. Credit offers cannot be refunded or taken as cash.

Responsibility

Group fares quoted for this tour are subject to a minimum 15 paying passengers travelling together. Phil Hoffmann Travel reserve the right to increase the tour price or cancel the tour should the members travelling not meet the required minimum.

We reserve the right to take any reasonable action should your health, actions or behaviour impinge on the rights, welfare or enjoyment of other passengers. Phil Hoffmann Travel reserve the right to cancel or withdraw any person as a member of the tour at any time.

Phil Hoffmann Travel reserves the right to amend any tours should the occasion demand. Also, if there are insufficient bookings to cancel the tour, Phil Hoffmann Travel does not accept liability for failure on the part of transportation companies, hotel contractors and other principals whose responsibility is confined to their own operations. Phil Hoffmann Travel reserves the right to alter hotels used should the necessity arise. The transportation companies or firms shall be exempt from all liabilities in respect of any detention, delay, loss, damage, sickness or injury and by whom so ever caused and whatever kind occurring of or to the passenger at any time when the passenger is not on board a conveyance used or operated by the transportation companies or firms. All ticket coupons and orders are furnished and issued subject in all respects to those terms and conditions under which the means of transportation or other services provided thereby are offered or supplied by the owners, operators, public carriers, management agents or agents.

INTERNATIONAL TOUR & CRUISE CONDITIONS

The free baggage allowance on flights is restricted to 20kgs per person for economy passengers and 30kgs per person for business class passengers. Whilst on tour one bag per person is allowed. Any charge for baggage in excess of these allowances will be at the passenger's expense.

Cancellations

Cancellations of firm bookings will be subject to $220 per person service fee (Bookings over $10,000 $550 per person) plus any charges imposed by principals involved in operating the tour at least 76 days before the date on which you are to commence travel (by air, rail, sea or otherwise. Passengers who cancel after that date for any reason, including medical or family reasons, as a general rule are subject to the following per person cancellation fees:

Fees incurred as a result of cancellation for the cruise or land operators cannot be applied to future bookings.

Insurance

We strongly recommend participants to take out insurance cover against loss of deposit and loss of airfares, personal accident, medical cover etc. If you have sought treatment or advice for treatment within the last 60 days or are on prescribed medication or over 70 years of age you are required to complete a pre-existing medical form for review by the Insurance Company. DOMESTIC TOUR CONDITIONS

Reservations

This deposit forms part of the total price, balance of which is due 45 days prior to the departure date from Australia. The full tour price is due at the time of booking made within 45 days of departure.

Baggage

The free baggage allowance on flights is restricted to 20kgs per person for economy passengers and 30kgs per person for business class passengers. Whilst on tour one bag per person is allowed. Any charge for baggage in excess of these allowances will be at the passenger's expense.

Cancellations

Cancellations of firm bookings will be subject to $55 per person (Australia GST inclusive) service fee plus any charges imposed by principals involved in operating the tour. Therefore, the cancellation fee may be up to the total cost for land and/or airfares.

Insurance

We strongly recommend participants to take out insurance cover against loss of deposit and loss of airfares, personal accident, medical cover etc. If you have sought treatment or advice for treatment within the last 60 days or are on prescribed medication or over 70 years of age you are required to complete a pre-existing medical form for review by the Insurance Company.
